Agency Overview

The Department of Revenue's core mission is to collect the revenues required to support the business of the Commonwealth, to make a difference in the lives of children by enforcing the financial responsibilities of parenthood, and to assist Massachusetts cities and towns in sound and efficient fiscal management.

Division Overview

The Resolution Division works with taxpayers, practitioners, and the other Tax Administration Divisions to address issues that could not be resolved in the Audit Division or Operations Division. This includes making decisions on abatement claims, resolving disputes, working with taxpayers on problem cases.

As a member of the Massachusetts bar in good standing, with minimal supervision, evaluates, develops and recommends resolution of complex, disputed tax matters; conducts hearings, negotiates settlements, prepares letters of determination, prepares settlement recommendations and prepares all related memoranda with respect to disputed tax matters and requests for settlement involving the most complex and difficult legal tax issues. Acts as liaison with others in DOR regarding the resolution of various disputed tax issues currently before DORParticipates in the review of drafted public written statements.Drafts administrative and legal documents. Supervises 1-4 appeals officers. Performs related work as required.

Required Qualifications

  • Ability to interpret and apply the laws, rules and regulations governing taxation.

  • Thorough knowledge of legal research methods and procedures including knowledge of electronic research tools

  • Ability to read and interpret legal documents such as decisions, briefs, opinions and contracts.

  • Ability to write concisely and effectively, to express thoughts clearly and to develop ideas in logical sequence.(i.e. Strong writing skills.)

  • Ability to conduct administrative hearings and negotiate settlements on complex, disputed state tax matters, or demonstrated significant parallel skills.

Preferred Qualifications

  • Knowledge of the laws, rules and policies governing the activities of the Office of Appeals and MGL Chapter 62C.

  • Knowledge of personal income tax and MGL Chapter 62.

  • Familiarity with tax returns and related documents.

Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar Association, and at least (A) six years of full-time, or equivalent part time, professional experience in the practice of law in a specialized area that is relevant to the assigned agency, of which (A) at least three years must have been in a supervisory capacity.

An external candidate recommended for a position with the Department of Revenue will be subject to a background check that includes checks for: state and federal tax compliance; child support compliance; education verification; Massachusetts CORI checks; criminal background checks in state(s) of current and previous residence/employment; validation of eligibility to work in the United States; and national fingerprint-based criminal background checks.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar Association, and at least (A) six years of full-time, or equivalent part time, professional experience in the practice of law in a specialized area that is relevant to the assigned agency. Based on assignment and supervisory responsibilities, three years in a supervisory capacity may be required.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
