General Summary:

Manages complex, high exposure claims and lawsuits arising out of Dallas Area Rapid Transit operations to obtain the most cost effective and beneficial outcome.

Essential Duties and Responsibilities:

ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • Reviews and evaluates claim files for liability exposure. Upon receipt of a lawsuit, determines DART's best strategy in defense of the suit.
  • Directs attorney involvement early on to properly develop a defense or resolution strategy that is in the best interest of DART.
  • Performs on-site investigations, when necessary, to obtain information needed to determine liability and to document the basis of DART's position on contested claims that result in litigation.
  • Evaluates all relevant expenses and analyzes lawsuits to develop a framework for resolution to develop a basis for settlement negotiations. Prepares reports with recommendations for disposition of claims to the Manager, Liability Claims. Settles claims within delegated authority levels. Prepares management reports as needed.
  • Presents settlement recommendations and requests for authority to the Manager, Liability Claims or Claims Committee when necessary. Reports must contain a summary of the facts, appraisals, and validated damages that were used to develop a settlement recommendation.
  • Attends mediations, trials and depositions as DART's representative and actively participates with attorney and mediator to obtain the most beneficial outcome for DART
  • Communicates with claimants, attorneys, witnesses, DART employees and any other relevant party and accurately documents these communications. Takes recorded statements when necessary.
  • Provides attorney with financial authority, when appropriate, to resolve lawsuits prior to trial.
  • Maintains accurate calendar and diary system to reflect all mediations, depositions, hearings and trials using RMIS. Works closely with DART attorney and Legal staff to maintain current legal status of all suits.
  • Actively participates in training of new employees and mentors less experienced adjusters.
  • Assumes the role of interim Manager, Liability Claims when authorized. Oversees time sensitive matters and makes sure daily activities are performed as needed.
  • Performs other related duties as assigned.


MINIMUM KNOWLEDGE SKILLS AND ABILITIES REQUIRED:

Note: An equivalent combination of related education and experience may be substituted for the below stated minimums excluding High School Diploma, GED, Licenses, or Certifications.

  • Bachelor's degree from an accredited college or university in Business Administration, Insurance or related field.
  • Five (5) years related experience in insurance claims adjusting, litigation management or related environment.
  • Pass a physical (medical) examination that includes a drug screen in order to operate DART non-revenue vehicles.
  • Must have a Texas Department of Insurance Casualty License.
  • Ability to work irregular hours and to be available to work on short notice.
  • Proficiency using a personal computer (PC) and established RMIS; software applications to include word processing, spreadsheet, database, etc.; typical office equipment such as copier, typewriter, calculator, facsimile, etc.
  • Ability to be dedicated to meeting the expectations and requirements of internal and external customers. Gets first-hand customer information and uses it for improvements in products and services. Acts with customers in mind. Establishes and maintains effective relationships with customers and gains their trust and respect.
  • Ability to make good decisions (without considering how much time it takes) based upon a mixture of analysis, wisdom, experience, and judgment.
  • Ability to pick up on technical things quickly. Can learn new skills and knowledge. Is good at learning new industry, company, product, or technical knowledge.
  • Ability to use rigorous logic and methods to solve difficult problems with effective solutions. Probes all fruitful sources for answers. Can see hidden problems.
  • Ability to be able to write clearly and succinctly in a variety of communication settings and styles. Can get messages across that have the desired effect.


WORKING CONDITIONS:

Works in an environment where there is minimum exposure to dust, noise, or temperature. May be moderately exposed to unpleasant working conditions to include dust, noise, temperature, weather, petroleum products, and chemicals while visiting DART's operating facilities, assuming incumbent is observing all policies and procedures, safety precautions and regulations, and using all protective clothing and devices provided.
