About the Role

The successful applicant will provide legal support to the Institutional business and have the opportunity to spend time in, learn about and provide legal support primarily across the Payments & Cash Management and Clearing businesses within Transaction Banking (PCM) and some opportunity to support the Wholesale Digital/Digital Solutions business. There will be a focus on payments and payment innovation including digital, payments and receivables, client monies and liquidity products. The role would suit a candidate that enjoys working in a changing and dynamic environment within a supportive and motivated team and who is curious to learn about the PCM and other aspects of the Institutional business.

What will your day look like?

  • Advisory – providing high quality legal support primarily to PCM including the provision of strategic, proactive and innovative legal advice to assist in meeting business objectives. This will include advising on business initiatives, product development and the impact of regulatory change on products.
  • Proactively manage legal risk primarily for PCM through the provision of a quality, timely, commercially relevant and cost effective legal service personally and through other Institutional Legal Group team members.
  • Drafting documents – primarily assisting PCM with drafting/amending non- standard documentation, terms & conditions (including for the provision of new or amended products), confidentiality agreements and other miscellaneous documents.
  • Negotiating documentation with customers (including other financial institutions) and their legal advisors regarding Transaction Banking Products and providing advice to the business in relation to non-standard or negotiated documents and tenders.
  • Conducting contract due diligence and primarily advising PCM in relation to ANZ's rights, risks and responsibilities in relation to a range of terms & conditions, various non-standard arrangements with customers (including other financial institutions), confidentiality arrangements and indemnities.
  • General legal advice – providing commercially relevant legal advice in connection with corporations law and governance (including in relation to financial services), contract law and regulatory issues (for example, Banking Code of Practice, ePayments Code, Privacy Principles, ASIC and APRA guidance or standards, SWIFT and Scheme Rules).
  • Liaising with external counsel –instructing external counsel or assisting the business to instruct external counsel with a view to delivery of cost efficient and high quality legal services.
  • Strategic objectives – participating in and advising internal projects and assisting Transaction Banking to achieve their strategic objectives.
  • Training and education – developing new skills, identifying training requirements within the business and facilitating new training, sharing knowledge and experience within the legal team, keeping business appraised of significant legal developments impacting them.
  • Liaise with Product, Risk and Compliance stakeholders to ensure consistent and effective risk management approach across Transaction Bankingwhen required and to proactively identify and engage with these stakeholders in relation to risk management.

What will you bring?

To grow and be successful in this role, you will ideally bring the following:

  • Lawyer with 8 years post qualification experience from either: a top tier Australian firm (or equivalent foreign firm) with experience in banking and finance law or an authorised deposit-taking institution or listed financial institution.
  • Excellent written and verbal communication skills.
  • An ability to provide commercially relevant legal advice.
  • Strong interpersonal skills with the confidence to liaise effectively with individuals at all levels including senior management.
  • An ability to work independently and exercise sound judgment regarding risks and mitigants associated with a variety of different transactions and initiatives.
  • Team focused with a flexible attitude and the willingness to go the extra mile.
  • Demonstrated capacity to work under pressure and in a changing environment in an accurate, calm and timely manner with the ability to reprioritise work to meet changing demands.
  • Common sense and an ability to learn on the job.
  • Strong general banking and finance law experience and/or specific experience in payments, cash management or digital solutions.
