PURPOSE OF POSITION:
The Manager, Real Estate Contracts and Billing is responsible for management of real estate permit and related contractual agreements for a wide variety of uses of ARRC property including temporary, short-term, or long-term uses by utilities, engineers, surveyors, environmental contractors, government uses for roads and public facilities or other general users. This position also manages the billing process for all real estate contracts and establishes processes to assure billing is accurate and based on contract requirements. This position recommends permit fees to provide appropriate return for various uses of ARRC property.
This position is also responsible for establishing filing standards for all real estate contracts including managing archiving real estate contract records in accordance with ARRC’s Records Retention Policy.
Duties and Responsibilities:
Responsible for management of real estate contracts for long-term corridor permits, track use, temporary, short term or non-exclusive use of ARRC property. Establishes application review process based on permit type. Reviews permit applications for use and determines appropriate review process required. Negotiates real estate contract terms and conditions consistent with ARRC’s statutes and land use policy. Recommends changes to the ARRC permitting policies and fee schedules.
Prepares and/or reviews draft real estate contracts and related documents based on terms and conditions to ensure compliance with applicable policy and guidelines and/or identifies potential problem areas such as unclear contract language or inadequate special conditions, including insurance considerations and makes recommendations to ARRC’s Legal Office for final review. Prepares and/or reviews miscellaneous draft contract amendments, permits, and right of way agreements
Develops and manages permit application workflow for all requests. Solicits and reviews comments received from other ARRC departments including Engineering, Transportation, Maintenance of Way, and Security, to incorporate special conditions or restrictions in the contract document to ensure contracts include appropriate safeguards to protect ARRC’s assets and operations from potential negative impacts by third party users.
Develops and maintains ARRC website for Real Estate including writing content to describe an overview of real estate application process, procedures, and application forms for various property access requests.
Supervises the Real Estate Permit Technicians; develops and delivers technical and customer service training.
Maintains metrics on real estate permit activities to reflect the volume and production of permits received, reviewed and issued. Prepares management reports making recommendations regarding ARRC’s permitting practices.
Participates in land-use planning and development for the ARRC Right of Way and master plans for all ARRC land reserves.
Manages the computerized Real Estate land management, permitting and billing system. Actively participates in software selection, project implementation, systems development and enhancements to system capabilities. Responsible for billing and collection of revenues due under real estate contracts and leases. Provides input to Accounting Department regarding credit to customers and settlement of disputes.
FACTOR 1: Technical and Operational Knowledge
Comprehensive understanding and knowledge of real estate concepts, principles and practices, and procedures related to land management, contract negotiation and administration. Demonstrates knowledge of land use permits, including right-of-way use contracts. Reviews and analyzes appraisals and property assessments. Some knowledge of land records, ability to read legal descriptions, maps, plats, and surveys. Reviews title reports. Reads and interprets standard insurance certificates.
Knowledge of Alaska Railroad Transfer Act, ARRC Long Term Lease Policy, ARRC Standard Specifications for Work on the Railroad, and other applicable laws and regulations affecting management of corporate lands. A thorough understanding of ARRC’s land holdings is used to research land records to verify ARRC’s title to property (fee simple, easement, interim conveyance, exclusive license).
Demonstrates a thorough knowledge of ARRC permits and the permitting process, including entry permits, blanket permits, utility permits, road crossing permits, special land use permits, temporary construction permits.
Exhibits advanced skill in a wide range of computer programs including MS Word, Excel, and PowerPoint. Knowledge of Real Estate database management systems, including experience training staff on systems concepts and data entry and maintenance. The Real Estate database system is the lifeline to the Real Estate Department’s daily operation and, therefore, accuracy is essential to a successful permitting program.
FACTOR 2: Analytical Skills & Impact
Conducts extensive research into regulations, policies, guidelines and/or prior contract agreements, to provide background information in order to incorporate appropriate contract terms and safeguards. Prepares well-documented, well-organized summaries or detailed data. Gathers information, analyzes facts, and provides sound recommendations. Adapts guidelines to resolve unique or unusual problems.
Problem solves and exercises judgment over a wide range of facts in order to resolve discrepancies in land use issues. Effectively analyzes and interprets data through system reports, spreadsheets, database information and research from on-line sources. Must be highly organized and detail-oriented, with the demonstrated ability to handle multiple projects simultaneously with tight deadlines, and demonstrating excellent time management and project management skills.
FACTOR 3: Supervision and Control
This position supervises the activity of Real Estate Permit Technicians. Provides training to ensure consistent performance and customer service. Acts as the Director of Real Estate in his absence.
FACTOR 4: Communication
Communication skills are a key attribute in this position. Written and verbal communications are both vital to contract management, problem solving, negotiating, and resolving conflicts and requires judgment and resourcefulness. Positive, proactive communication is the key to providing good customer service and resolving difficult situations. Must be able to communicate effectively with a multitude of public entities, public officials, corporations, commercial contractors, professional engineers, surveyors, etc. and private parties which requires professional demeanor in order to meet competing demands and deadlines.
Ability to establish and maintain effective working relations with a wide variety of individuals.
Ability to negotiate, persuade, and/or motivate others to reconcile disparate opinions.
FACTOR 5: Working Conditions
Typical office setting. Requires fieldwork on a regular basis to meet with tenants, contractors and ARRC employees to perform site inspections of Railroad properties. Fast paced environment. Requires the ability to be flexible and multi-task. Ability to work in a team environment; ability to work with a diverse group of professionals, including engineers, contractors, and attorneys.

Education Requirements
Bachelor’s degree from an accredited institution with a major in real estate, public or business administration, land management, or a related field is required. Professional experience as described below may be substituted for the degree on a year-for-year basis.
Work Experience
Three (3) years of professional experience in public or commercial real estate contract management is required. Five (5) years of experience overseeing the use of land management database systems, including responsibility for automated billing for at least one thousand contracts is required. One (1) year of supervisory or lead experience is required.
