Job Description

Superviseandcompletethenegotiation, draftingandadministrationofcontractsfor thepurchase,saleandleaseofrealproperty.Analyze due diligence materials to identify andresolve title, survey, environmental, zoning and design issues to determine feasibility of real propertypurchasesand leases for new store growth locations.

ESSENTIAL JOB FUNCTIONS

Prepare legal documents for the acquisition of real property interests and construction of improvements, including contracts, easements, development agreements and indemnification agreements.

Supervise completion of contract/lease contingencies and conditions during contingency period of purchase contracts and leases.Identify, analyze and resolve title, survey, environmental, zoninganddesignissuestodeterminefeasibilityof realpropertypurchasesandleases.

Coordinate closing of real estate purchase and sale contracts and finalizing leases.

Negotiate with outside parties for the acquisition of real property, including purchase contracts, leases and amendments thereto.

Assurecompliancewithlawsandregulationsaffectingrealpropertypurchaseand development activities, including environmental compliance.

Research laws affecting real property interests and provide advice and counseling to the officers and senior management of the company.

Collaborate with Site Acquisitions team in drafting and editing acceptable Letters of Intent for contracts for the lease or purchase of real property.

Work with Contract Negotiations group on issues and drafting of acceptable real estatepurchase contracts.

Work with Lease Negotiations group on the drafting and negotiation of leases.

Work with Property Management team to resolve landlord-tenant disputes, lease administration issues, and managing litigation.

Provide such additional and further professional services to promote the best interests of the Company and as assigned by the General Counsel, or Associate General Counsel/Senior Director of Legal Services.

SKILLS/EDUCATION/EXPERIENCE

Required:

Jurisdoctoratefromanaccreditedlaw school.

Currentlicensetopracticelawinatleastone state.

5+ years legal experience in private practice or as in-house counsel

3+yearstransactionalrealestateexperience,includingcommercialleasingand land/building acquisitions.

Excellentanalyticalanddrafting skills.

Strongnegotiatingand problem-solving skills.

Excellentcommunicationandinterpersonal skills.

Experiencedealingwithandmanagingoutsidevendorsand attorneys.

Abilityanddesire toworkindependentlyandcross- functionally.

Abilityto managetightdeadlines and excelin afast-paced,high volume environment.

Desired:

Experiencein environmental law, construction law, landuseand zoning, resolutionofcommercialpropertymanagement issues and realestate litigation.
