Material Bank is seeking a senior Privacy & Product Counsel to join our Legal team as the company’s second lawyer. This is a builder’s role with significant ownership and visibility across the organization. You’ll advise the business on a broad range of legal matters, with particular focus on the questions that arise where product, data, privacy, marketing, and commercial partnerships meet.
You’ll partner closely with Product, Engineering, Design, Marketing, Sales, People, and other teams to help the company move quickly while managing legal and regulatory risk thoughtfully. You’ll also help build the processes, templates, playbooks, and systems that allow a small legal team to scale effectively.
This role suits someone who combines strong legal judgment with a practical, business-oriented mindset. You’re comfortable working outside your immediate area of expertise, prioritizing in a fast-moving environment, and finding solutions where the answer isn’t always obvious.
What you’ll do
- Lead Material Bank’s data privacy strategy and compliance efforts (e.g., CCPA, GDPR, and emerging U.S. and international privacy regimes), including owning our privacy notices, advising on data collection, use, retention, and handling practices, conducting privacy impact assessments, and supporting incident response protocols.
- Partner with Product, Engineering, and Design teams throughout the product development lifecycle to provide practical legal guidance on new products and features, consent workflows, data collection mechanisms, user agreements, and regulatory requirements.
- Advise the Marketing team on consumer protection, advertising, endorsements, promotions, CAN-SPAM, TCPA, FTC guidance, and other customer-facing legal requirements.
- Draft, review, and negotiate a broad range of commercial agreements, including customer and vendor agreements, data processing terms, NDAs, marketing and sponsorship agreements, technology agreements, and strategic partnership arrangements.
- Help build and improve legal operations, including template and playbook development, contract management, legal intake, knowledge management, workflows, automation, and internal processes.
- Leverage AI and legal technology to automate repetitive work, improve legal service delivery, and help the Legal team scale.
- Provide practical legal guidance on matters outside your core areas of expertise, which may include corporate transactions, employment matters, intellectual property and trademark issues, disputes, etc.
What you’ll bring
Required:
- JD from an accredited law school and active bar membership in good standing in at least one U.S. jurisdiction, or eligibility to register as in-house counsel where required.
- 5+ years of relevant legal experience, including meaningful in-house experience (ideally at a high-growth technology company).
- Strong substantive experience in data privacy and product counseling.
- Working experience in marketing/consumer protection and commercial contracts.
- Strong legal judgment and the ability to translate complex legal requirements into clear, practical business guidance.
- Experience operating in resource-constrained or fast-moving environments where prioritization, judgment, and adaptability are essential.
- Curiosity, adaptability, and comfort taking ownership of matters that may fall outside your existing expertise.
Preferred:
- CIPP/US, CIPP/E, or another privacy certification, but equivalent substantive experience is equally valued.
- Experience building or scaling legal processes, templates, playbooks, contract management systems, or other legal operations infrastructure.
- Comfort using AI-assisted legal tools and a bias toward automating repetitive work.
