Shared Health leads the planning and coordinates the integration of patient- centered clinical and preventive health services across Manitoba. The organization also delivers some province-wide health services and supports centralized administrative and business functions for Manitoba health organizations.

Position Overview

Reporting to the Provincial Lead, Legal Services (Shared Health), the Legal Counsel – Labour & Employment will provide legal services in a dynamic multidisciplinary environment and will be responsible for:

  • Management, negotiation and preparation and conduct of labour arbitrations, labour board matters and interest arbitrations.
  • Preparing appropriate pleadings and/or responses to various human rights, labour board and/or other administrative or related civil litigation.
  • Negotiating settlements involving employment and labour relations issues on behalf of health employer within Manitoba.
  • Providing legal advice and services to Shared Health, the WRHA and other clients within the Health System in Manitoba concerning collective agreement interpretation, human resources matters, labour relations issues and negotiations.
  • Anticipating and identifying legal issues and consulting with senior counsel and operational leads to develop legal strategies and solutions, often in situations of substantial risk or significance and with limited time for assessing alternatives.
  • Conducting legal research and analysis.
  • Preparing written and verbal opinions as needed.
  • Advising on recruitment, evaluation and termination of staff and related legal or court challenges and on all matters relating to The Labour Relations Act, The Human Rights Code, The Essential Services Act, The Employment Standards Code and all related legislation governing employee/employer relations and employment standards.
  • Providing legal advice and services respecting contracts with human resources/labour relations implications.
  • Providing advice with respect to privacy and access legislation.
  • Drafting and/or reviewing of policies and procedures relating to employment and labour issues.
  • Educating and training the health community about emerging labour relations, human resources or related legal issues.
  • Liaising with external counsel as required.
  • Adheres to all safety and health regulations and safe work practices.
  • May be required to perform other duties and functions related to this job description not exceeding above stated skills and capabilities.

Experience

  • Minimum of two (2) years as a practicing lawyer or a commensurate combination of labour law experience and years as a practicing lawyer.
  • Strong experience in labour and employment law.
  • Experience working with the health care sector is an asset.

Education (Degree/Diploma/Certificate)

  • Bachelor of Laws (LL.B.) or Juris Doctorate (J.D.).

Certification/Licensure/Registration

  • Member in good standing with the Law Society of Manitoba.

  • Proven ability to lead and work within a dynamic, fast-paced team environment.
  • Excellent communication, analytical, advocacy, organizational and interpersonal skills required.
  • Demonstrated ability to write and think concisely and analytically.
  • Excellent negotiating and drafting skills required.
  • Ability to exercise sound and impartial judgment in challenging situations.
  • Knowledge of current and developing legal issues and trends in labour and employment law.
  • Proven ability and aptitude for recognizing, investigating and analyzing problems, and for developing innovative solutions to complex situations.
  • Ability to communicate and work effectively with staff at all levels, both verbally and in writing.
  • Proven ability to work within a dynamic team-oriented environment where the range of responsibilities is varied.
  • Ability to work independently and willingness to assume additional responsibilities.
  • Ability to plan, schedule and complete work in a concise, clear, accurate and timely manner.
  • Computer knowledge and experience in a Microsoft Office environment.

Physical Requirements

  • Must be willing and able to travel and work from various client locations within the Province of Manitoba.
