Course Description: This course examines the nuanced legal framework governing the ownership, administration, and partition of property in Québec, as governed by the Civil Code of Québec, in the context of marriage and de facto and parental unions. The course will focus on family property and will explore:
Québec’s family property regimes, including the laws governing family patrimony, the matrimonial regimes of partnership of acquests and separation as to property, and the parental union patrimony; marriage contracts and cohabitation agreements, including their scope, limitations and issues of public order; partition of family property, whether held directly by individuals or by third parties, companies or trusts, pursuant to the applicable regime; and differences in the treatment of married couples, de facto spouses and parental unions in succesion matters.
TQR: At a minimum, a first degree in law. Several years of significant practice or professional experience, in the relevant area; Experience in teaching undergraduate law students in a bilingual setting
