Job Title: Labor and Employment Counsel, Agency Proceedings

Reports To: Associate General Counsel

FLSA Status: Non-Exempt

Location: On-Site in Scottsdale, AZ

POSITION SUMMARY

The Company seeks an in-house attorney with 3+ years of experience managing administrative agency matters to lead end-to-end proceedings before the EEOC, NLRB, U.S. Department of Labor, and relevant state and local agencies. This role will have end-to-end ownership of employment-related agency charges and demand letters, provide regular and timely reporting of trends and compliance recommendations, conduct internal investigations, assess reductions in force processes, and develop internal training to drive timely, compliant, and practical outcomes while preserving the Company’s legal rights.

RESPONSIBILITIES

• Intake and triage new demand letters and agency charges, complaints, petitions, and inquiries; assess risk, set strategy, and establish matter plans and timelines.
• Lead privileged investigations and fact development, including document review, custodian interviews, chronology building, and issue-spotting.
• Prepare, draft, and file demand letter responses, position statements, responsive submissions, affidavits, and declarations; coordinate data and document collection to meet agency deadlines.
• Manage agency discovery and information requests, including subpoenas, interrogatories, requests for information, and on-site inspections, ensuring timely, accurate responses.
• Represent the Company in agency mediations, conciliations, fact-finding conferences, and settlement conferences; develop negotiation strategies; evaluate and negotiate settlements; draft and review settlement agreements and related releases.
• Provide clear, practical guidance on agency process, risk, and best practices; provide timely and regular reporting on lessons learned and post-resolution compliance recommendations to prevent recurrence.
• Monitor trends in agency activity affecting the Company; coordinate with HR to update policies and training materials accordingly.
• Conduct privileged internal investigations as assigned.
• Collaborate with HR to review and assess reductions in force to ensure compliance with state and federal law.
• Assist Associate General Counsel with miscellaneous labor and employment law needs as assigned.

QUALIFICATIONS

• Juris Doctor from an accredited U.S. law school
• Active license in good standing with the State Bar of Arizona or ability to obtain Arizona licensure promptly via admission on motion or in-house registration, as applicable.
• Minimum 3 years of experience handling administrative agency matters at the EEOC, NLRB, U.S. Department of Labor, and/or state or local equivalents, whether in-house or in private practice.
• Demonstrated experience drafting legal correspondence, position statements, managing agency discovery and information requests, and participating in mediations, conciliations, and hearings before agencies.
• Proven ability to conduct and lead privileged workplace investigations and to develop factual records that support legal defenses and resolution strategies.
• Strong legal writing, advocacy, and analytical skills with the ability to meet tight deadlines and manage a high-volume docket.
• Experience coordinating with HR and business stakeholders and managing outside counsel to budget and plan.
• Familiarity with document preservation, legal holds, and defensible collection practices in the agency context.
• High proficiency in Microsoft Office, matter and document management platforms, productivity and collaboration applications, and similar business and legal technology.
• Ability to manage multiple tasks and meet deadlines in a fast-paced environment.
• Comfortable and capable of working with little supervision and within variable degrees of supervision, solo and within a lean in-house team, in a fast-paced environment to prioritize workload across a growing, multistate organization.
• Understand and adapt to various competing business and legal needs.

WORK CONDITIONS & SCHEDULE

• Full time - variable (typically M-F, business hours may occasionally begin in Eastern Time Zone through Pacific Time Zone); because this role supports business partners and coordinates with outside counsel in all U.S. time zones, some flexibility in workday is required.
• Type or otherwise input text in computer and manipulate mouse or similar adaptive device.
• Speak clearly on telephone, in remote meetings and in person so listeners can understand.
• Understand the speech of another person on telephone, in remote meetings and in person.
