The Executive Director, Litigation & Employment represents the Company and its affiliates in disputes, litigation and investigations, including overseeing and managing outside counsel, monitoring and managing legal expense, providing appropriate internal legal support to business colleagues, overseeing discovery, anticipating future litigation trends, and providing professional support, advice and counseling to assist the Company in managing complex litigation and employment issues, and mitigating litigation risk. The role requires litigation and counseling expertise, including sound evaluation of liability and damages issues, practical assessment of strategies and risks, the negotiation of fair and equitable resolutions, and leadership in developing and implementing process improvements in response to legal developments.
A successful candidate must be able to operate with considerable independence in consulting, advising, and representing the Company on a variety of highly complex legal matters. The candidate must be a team player, be willing to lead special projects as needed, manage and motivate team members, including professional support staff, provide real-time advice and counsel to business clients, and be able to balance multiple, competing priorities on a regular basis.

Responsibilities
Litigation & Dispute Strategy & Management
- Oversees and manages external counsel, experts, and vendors on a variety of commercial litigation, disputes, and government investigation matters, including budgeting and bill review.
- Provides strategic oversight and direction of complex legal matters at both inventory and individual matter level.
- Drives, manages and coordinates discovery, including response strategy, litigation holds, information gathering, e-discovery, document collections, and privilege reviews.
- Directs motion practice on routine and complex issues.
- Develops tactics and strategy with external counsel to ensure company is in best position to defend itself against various claims
- Represents the company and its employees in meetings with and inquiries from various third parties; directs strategic coverage and prepares company employees for deposition and trial.
- Oversees retention of expert witnesses and local counsel.
- Manages the day-to-day expenditure of external legal costs in a prudent manner in coordination with the legal billing team.

Risk Analysis & Mitigation
- Advises on business and legal risks associated with litigation and labor and employment matters.
- Proactively anticipates future litigation and enforcement trends.
- Manages pre-litigation demands.
- Manages response to indemnification demands.
- Delivers counsel to business clients on issues germane to ongoing litigation, government investigations, labor and employment.
- Identifies opportunities for efficiencies, coordinates with colleagues and vendors on process improvements.
- Oversee and conduct internal investigations.
- Author, update, and implement policies, procedures and conduct trainings.

Employment Counseling and Litigation
- Effectively engage in employment litigation and counseling, including giving advice to internal stakeholders
- Deep knowledge of employment discrimination, wrongful termination, violation of whistleblower laws and the Family and Medical Leave Act, the WARN Act, the Fair Labor Standards Act, and other state and federal employment statutes
- Partner with Human Resources and Corporate Compliance in solving complex employee relations issues and employee termination or discipline, while also assisting in investigations and reporting findings.
- Manage or assist in creation, modification and review of Employment policies and guidance documents, and employee and Compliance training on relevant topics
- Collaborate with external counsel representing company before state, federal and administrative agencies in devising tactics and strategy for successful dispositions
- Draft various employment contracts, including employment agreements and separation and release agreements

Stakeholder Management
- Consulting partner who works closely with business units and external counsel to provide practical and timely advice to mitigate risk in support of business objectives.
- Facilitates efficient coordination between internal and external stakeholders.
- Provides input to finance for budget development and tracking.

- Evaluates insurance coverage and works with the company’s brokers to maximize available coverage.

Qualifications
Education & Experience
- JD degree from an ABA accredited law school; top 30% and/or law journal preferred.
- Admission to state bar required.
- Minimum 15 years legal experience handling litigation matters, particularly matters involving products liability, class action, mass tort, multi-district litigation/coordinated proceedings, consumer protection, government investigations, antitrust, commercial disputes, securities, and labor and employment.
- 4+ years of large law firm experience preferred.
- 8+ years of in-house litigation management experience preferred.
- Federal or State Clerkship preferred
Knowledge
- Strong understanding of litigation and alternate dispute resolution process.
- Understanding of handling administrative claims.
- Basic contract terms and conditions.
