Mission:
The mission of the Texas Department of Banking is to ensure Texas has a safe, sound, and competitive financial services system.
General Description:
Performs entry-level to routine legal work, examining and preparing legal documents, drafting rules and legislation, rendering legal advice and counsel, and representing the Department in administrative hearings. Work is performed under the direction of the General Counsel with limited latitude for the use of initiative and independent judgment.
Job Duties:
• Advises Department staff regarding effective and proposed state and federal laws and regulations relating to the agency or regulated entities.
• Advises Department staff, regulated entities and general public on the interpretation and application of laws and regulations administered or enforced by the Department.
• Performs legal research.
• Prepares and reviews legal documents, reports, legal opinions and briefs.
• Assists in reviewing and drafting legislation and rules.
• Assists in formulating, coordinating and establishing Department policies and procedures.
• Assists with administrative enforcement actions and represents the Department in administrative hearings.
• Performs other duties as assigned.
Minimum Qualifications:
Education and Experience:
Attorney I:
• Graduation from an accredited law school with a LL.B. or J.D. degree.
• Member in good standing with the Texas State Bar.
Attorney II:
• Same education as Attorney I
• Two years of experience as an attorney, which includes experience with state and/or federal regulatory, compliance, trust, or other issues related to financial institutions or similar.
• Member in good standing with the Texas State Bar.
Copy of official college transcripts must be submitted with The State of Texas Application for Employment.
Preferred Qualifications:
• Knowledge of laws, regulations, and rules applicable to entities regulated by the Department of Banking.
• Knowledge of and experience in business and commercial law.
• Experience in administrative and civil litigation.
• Knowledge of the Texas Administrative Procedure Act and the Texas Public Information Act.
• Experience in drafting legislation and regulations.
• Knowledge of laws, regulations and practices pertaining to state and national banks and money services businesses.
• Knowledge of state laws and regulations pertaining to perpetual care cemeteries and prepaid funeral contracts.
Knowledge, Skills, and Abilities:
• Knowledge of legal principles, practices, and proceedings and of laws and regulations, and rules related to the agency.
• Ability to conduct hearings, to prepare opinions and briefs, to interpret and apply laws, to use reason and logic in identifying and solving complex problems.
• Ability to prioritize workloads and use judgment to identify courses of action.
• Excellent communication skills, both oral and written.
• Skill in legal research, writing and analysis.
• Ability to maintain effective public relations.
• Competency in the use of computers.
• Ability to maintain effective working relationships with supervisors, co-workers, team members, regulated entities, and the public.
• Ability to exercise initiative and independent judgment.
Special Requirements:
• Position requires at least 5 % overnight travel.
• Must possess or obtain within 90 days a valid Texas Driver’s license. Satisfactory driving records are required for driving any vehicle to conduct agency business. Final applicants must certify that personally owned vehicles used for agency business have Texas minimum liability coverage and a valid state inspection.

This position requires the incumbent to primarily perform sedentary office work; however, mobility (standing and walking) is routinely required to carry out some duties. It requires extensive computers, copiers, printers, telephones, and client/customer contact. The job also requires normal cognitive abilities requiring the ability to learn, recall, and apply certain practices and policies. It requires the stamina to maintain attention to detail despite interruptions and maintain regular and punctual attendance. Marginal or corrected visual, speech and auditory requirements are required for reading printed materials and computer screens and communicating with internal and external customers. Overnight travel is at least 5 %.
