DISTRICT COURT COMMISSIONER DEBT COLLECTION AND HOUSING ACTION DIVISION

The Utah State Courts seek two experienced officials to serve as District Court Commissioners (Division Commissioner) in the newly established Debt Collection and Housing Action Division. These positions have statewide jurisdiction and will be housed within the Matheson Courthouse, located in Salt Lake City. Division Commissioners are appointed by the Judicial Council. Under the direction of the Board of District Court Judges, Division Commissioners will perform duties consistent with Utah Code 78A-5-103 (Effective 1/1/2027) pertaining to the Debt Collection and Housing Action Division of the District Court.

Successful candidates will adhere to the Code of Judicial Conduct and be a member of the Utah State Bar in good standing. The candidates must be at least 25 years of age, a citizen of the United States, a resident of Utah for three (3) years preceding appointment, and a resident of Utah while serving as Commissioner. Successful candidates must reside in the State of Utah.

Salary: $97.24 hourly / $203,037 annually

Number of Openings: Two (2) Full-time, FLSA-exempt, at-will positions with benefits. The Court Commissioner position is a quasi-judicial officer as provided by the Utah Code and the Code of Judicial Conduct. THIS POSITION IS SUBJECT TO JUDICIAL COUNCIL APPROVAL. These positions are projected to begin in November 2026.

Job Description and Example of Duties

The Court Commissioner is a quasi-judicial officer as provided by the Utah Code and the Rules of the Judicial Council. Division Commissioners have statewide jurisdiction, housed in the Matheson Courthouse located in Salt Lake City. Commissioner positions are appointed by the Judicial Council. Under the direction of the Chair of The Board of District Court Judges, the Division Commissioners will perform duties consistent with Utah Code 78A-5-103 (Effective 1/1/27) pertaining to the Debt Collection and Housing Action Division of the District Court including:

1. Set pretrial conferences;
2. Conduct settlement conferences;
3. Refer appropriate cases to mediation where available;
4. Make a record of parties’ settlement agreements;
5. Review pleadings and status of discovery;
6. Manage supplemental hearings and post-judgment collections, and certify cases ready for trial;
7. Resolve objections to writs;
8. Hold occupancy hearings and makes recommendations;
9. Help establish and strengthen the Division by providing recommendations to the District Court regarding caseflow management and court processes.
10. Make recommendations to the District Court regarding any issue, including recommendations for entry of final judgment; and
11. Perform other division commissioner duties as assigned by the Board of District Court Judges.

Typical Qualifications

• Must be at least 25 years of age, a citizen of the United States, a resident of Utah for three (3) years preceding appointment, and a resident of Utah while serving as Commissioner.
• Must reside in the State of Utah.
• Member of the Utah State Bar in good standing.
