This position will consult with in-house counsel, finance, operations, brokers, third party claim administrators, and insurers to analyze and select the best risk resolution options to protect the organization against unforeseen losses. Management and supervision of claim activities with in-house claims staff, insurance carriers, third party administrators, and defense counsel are key components of the position. Insurance responsibilities include the oversight and management of workers' compensation, general liability, automobile liability, umbrella, excess umbrella, property, builders risk, installation floater, and executive liability insurance policies. Additional responsibilities include preparing and presenting loss analysis, budgets, and risk allocation programs to senior management.
Essential Functions:
Train and manage staff of in-house claims specialists handling high volume of workers’ compensation claims and third-party auto and property claims.
Manage litigation portfolio through coordination with third party administrators, outside counsel, and insurance adjusters.
Attend mediations and negotiate resolutions of presuit claims and litigation.
Oversee collection and disclosure of information and document production in discovery.
Resolve disputes with subcontractors over risk transfer and other issues, including contractual indemnity and insurance coverage.
Preparation of detailed exposure submission and applications for property, casualty, workers’ compensation and executive liability insurance programs; assist with negotiating coverage, terms, retentions, pricing including the preparation of spreadsheet and analysis on program and pricing for finance and senior management.
Review all insurance policies and premium invoices, contracts and maintain a schedule of insurance coverages.
Schedule and monitor loss control visits and respond to internal and external recommendations and communications.
Assist operations with bonding, special contract insurance requirements including, but not limited to RRP policies, installation floaters, builders risk policies, CIPs and OCIP programs.
Review and forecast all retrospective rating plan refunds and additions.
Management and oversight of internal and external insurance carriers and agencies, conduct internal and external audits ensuring accuracy and optimal asset utilization while reducing risk.
Lead, manage and oversee relevant corporate activities related to claims.
Support contract teams in the review, interpretation, and evaluation of contracts, requests for Proposals (RFPs), bids, etc. while working with business operations and senior management to ensure awareness of contractual provisions and risks.
Work with contracts team and other risk management teams to develop risk management standards, tools, processes and process improvements to mitigate calculated, organizational risks.
Management and oversight of Certificates of Insurance and maintain all insurance records including binders, policies and other coverage placement documents
Performs other related duties as required and assigned.
Minimum Requirements:
Bachelor Degree in Business. MBA is a plus.
CPCU, ARM, CIC designation or equivalent industry experience.
Eight plus years in the construction or utility business. Significant experience working with the rank and file (field associates) is a definite plus.
Eight plus years as a Corporate Risk Manager or, Director or VP with a large multinational construction, mining or utilities company (500+ mm annual sales/receipts).
Negotiations experience and a track record of success working with insurance carriers.
Five plus years of extensive finance and accounting experience / background.
Two plus years of managing and leading a staff of at least three employees.
Ability to work independently with minimal supervision.
