Job Description

The Minnesota Supreme Court seeks an attorney to serve as the Director of the Office of Lawyers Professional Responsibility (OLPR) and the Client Security Board (CSB). The OLPR investigates complaints of unprofessional conduct against Minnesota attorneys. The CSB considers claims filed by, and decides on compensation for, victims of attorney theft.

The Director manages the day-to-day operations of the OLPR, supervises the employees of that office, prepares and submits to the Lawyers Professional Responsibility Board an annual report covering the operation of the OLPR, and provides other reports requested by the Lawyers Professional Responsibility Board and the Supreme Court.

Additionally, the Director oversees the activities of the CSB by screening claims for compensation, coordinating investigations, and presenting matters to the CSB.

EXAMPLES OF JOB DUTIES:

  • The OLPR administers the Supreme Court’s lawyer discipline system. The OLPR Director supervises a staff of 23, including 12 lawyers, and leads OLPR’s day-to-day operations. The Director and the assistants review complaints of misconduct against lawyers, conduct investigations, and litigate contested discipline matters, including in proceedings before appointed referees and the Minnesota Supreme Court. The Office also provides legal advice and education programs to lawyers on professional responsibility questions, and works with the Supreme Court’s other professional regulatory agencies, including the Office of Lawyer Registration, the Board of Law Examiners, and the Board of Continuing Legal Education.
  • The Director sets investigative priorities for the OLPR, manages case inventory and timely resolution, develops staff, and promotes consistent decision-making and public confidence in the lawyer discipline system.
  • The Director of the OLPR and CSB is an at-will employee who is appointed by and serves at the pleasure of the Supreme Court. The Director’s performance is evaluated by the State Court Administrator, with input from the Lawyers Professional Responsibility Board and the CSB. The Lawyers Professional Responsibility Board is comprised of 23 members including 9 non-attorneys. The CSB is a group of seven volunteers appointed by the Supreme Court.
  • The operations of both Boards are funded by annual attorney registration fees, and the Director is responsible for preparing and administering the budgets for both Boards.
  • The Director also works closely with volunteer district ethics committees that investigate many of the complaints and report their findings and recommendations to the Director.
  • The position of Director is a highly visible role, involved in outreach activities and speaking engagements statewide, as well as writing 8-10 monthly columns per year for the Minnesota State Bar Association’s monthly journal, Bench & Bar.

TYPICAL QUALIFICATIONS:

Qualifications

  • A law degree from an accredited law school.
  • A current Minnesota law license.
  • Extensive experience as an attorney in private or public practice, including at least 3 years of trial and civil litigation experience and some appellate experience. 10 + years overall experience is preferred.
  • Administrative and supervisory experience.
  • Experience with attorney discipline cases.
  • Outstanding writing, public speaking, presentation, and interpersonal skills.
  • Applicants active with state or county bar associations highly desirable.
  • Experience delivering professional education or leading other public-facing initiatives in the legal community is preferred.
  • Offers of employment will be subject to BCA criminal background check and attorney records check.

Knowledge, Skills and Abilities:

  • Extensive knowledge of the rules of professional conduct and responsibility governing the legal profession, and related case law and opinions of the Lawyers Professional Responsibility Board.
  • Extensive knowledge of substantive and procedural law, including Supreme Court rules and case law.
  • Extensive knowledge of trial and appellate court procedures and rules of evidence.
  • Considerable knowledge of modern management and supervisory principles and practices.
  • Ability to plan, assign, and direct the work of legal and support supervisory positions.
  • Ability to prepare and manage the operating budget for OLPR programs and the CSB.
  • Ability to provide sound advice and counsel to the Lawyers Professional Responsibility Board and the CSB on the application of rules, policies, procedures, and matters under consideration.
  • Ability to establish and maintain effective working relationships with the Lawyers Professional Responsibility Board, District Ethics Committees, Client Security Board, Chief Justice, Supreme Court liaison to the Lawyers Board, State Court Administrator, state and local bar associations, regional law schools, civic organizations, employees, and the general public.

SALARY: The expected starting salary range for external candidates is $68.65-$87.54/hour ($143,341 - $182,784 annually). The full salary range for this position is $68.65 - $106.42 per hour ($143,341- $222,205 annually). This is an at-will position that is not covered by the Fair Labor Standards Act and is not eligible for overtime pay under that Act. This position is eligible for State of MN employee benefits.

Position Logistics:

This position’s formal classification title is Director of Lawyers Responsibility Board. Work is performed in a hybrid environment that is a mix of both remote and in-person work as business need dictates. In-person work will be performed at the Minnesota Judicial Center in Saint Paul.
