Summary:

As the Cyber portfolio continues to grow, the Cyber Claims Counsel will play a meaningful role in the development of the Cyber Claims organization. This position manages high-exposure and complex Cyber claims and brings deep expertise in cyber coverage, privacy and data security matters, and claims handling. The role focuses primarily on first- and third-party Cyber claims, including ransomware, business email compromise, data breaches, privacy events, business interruption, Technology Errors & Omissions (E&O), media liability, regulatory investigations, and related litigation. The position offers significant autonomy, visibility, and the ability to influence claim outcomes and the continued expansion of the business.

Essential Functions

• Manage a diverse portfolio of complex first- and third-party Cyber claims from initial notice through resolution.
• Analyze policy language, coverage, liability, damages, financial exposure, and litigation risk; establish appropriate reserves and provide accurate claim assessments involving Cyber, Technology E&O, privacy, network security, business interruption, and media liability coverages.
• Draft coverage position letters, reservation of rights letters, and other timely, clear, and well-supported claim-related communications.
• Evaluate and manage high-severity matters, including ransomware events, business email compromise, data breaches, privacy incidents, class actions, regulatory investigations, business interruption losses, and complex technology disputes.
• Develop and execute strategic claim resolution plans, including reserve, payment, and settlement decisions within delegated authority and escalation of complex, sensitive, or high-exposure matters requiring higher-level approval.
• Coordinate with breach counsel, forensic investigators, forensic accountants, defense counsel, and other incident-response vendors while collaborating on strategy, service quality, and expense.
• Collaborate with underwriting, actuarial, legal, cybersecurity resources, and senior leadership on emerging threats, claim trends, loss development, and portfolio performance.
• Build and maintain strong relationships with insureds, brokers, breach counsel, defense counsel, incident-response vendors, and business partners.
• Contribute to the continued growth and development of the Cyber claim’s operation, including knowledge sharing, training, process improvement, and cross-functional workflows.
• Prepare large-loss assessments, claim summaries, authority requests, and management reports, and present complex matters to senior leadership and claim committees as needed.

Qualifications

• Juris Doctor (JD) from an accredited law school.
• Active bar admission in at least one U.S. jurisdiction and in good standing.
• 5+ years of experience handling Cyber claims, insurance coverage matters, cybersecurity and data privacy matters, coverage litigation, or related complex litigation.
• Strong knowledge of Cyber insurance coverage, including first- and third-party coverages, privacy and network security, business interruption, Technology E&O, and media liability.
• Experience evaluating complex coverage issues, incident-response considerations, and large-loss exposures.
• Carrier-side Cyber claims experience preferred.
• Experience handling ransomware, business email compromise, data breach, privacy, business interruption, Technology E&O, or media liability claims preferred.
• Background coordinating breach counsel, forensic investigators, forensic accountants, defense counsel, and other incident-response vendors preferred.
• Experience assessing breach-notification obligations, regulatory matters, class actions, and high-exposure Cyber disputes preferred.
• Cybersecurity, data privacy, insurance coverage, Technology E&O, or professional liability expertise preferred.

SALARY: The estimated salary range for this position is $150,000.00 - $200,000.00 per year. This is a good-faith assessment of the salary range for this position only. In determining the actual salary within this range, MSIG USA will consider a candidate’s relevant experience, location, and other job-related factors.
