This position will be based in Charlotte, NC.

Reporting

This position will report to the Assistant General Counsel.

of Role
The Corporate Counsel is a practical, solutions-oriented attorney who takes ownership of case strategy, managing outside counsel, and driving favorable outcomes for the business. As a trusted advisor, the Corporate Counsel will also have a lead role in important corporate initiatives such as managing the company’s dispute portfolio, overseeing discovery and e-discovery processes, conducting internal investigations, and serving as a key cross-functional contact on litigation risk.


Strategic & Tactical

  • Manage and oversee the company’s litigation matters, including pre-litigation disputes, active lawsuits, arbitrations, and similar escalated disputes from inception through resolution
  • Proactively manage regulatory investigations and inquiries (such as attorney general investigations and contractor’s board complaints) by finding resolutions to such investigations and forging relationships with applicable regulatory offices.
  • Manage insurance claims from filing and discovery through resolution. Partner with insurance and risk teams to create transparent and streamlined claims processes.
  • Select, retain and manage outside counsel, including negotiating engagement terms, setting case budgets and monitoring performance against litigation objectives
  • Develop and execute litigation strategy, including drafting and reviewing pleadings, motions, discovery responses, settlement agreements and other litigation-related documents
  • Oversee e-discovery processes, including preservation, collection, review and production of electronically stored information in coordination with internal IT and business teams
  • Provide day-to-day counsel to internal stakeholders on litigation risk, dispute avoidance strategies, and escalation of potential claims, including advising on litigation holds and document retention obligations
  • Evaluate and drive resolution of disputes through negotiation, mediation, arbitration and litigation to achieve outcomes aligned with the company’s business objectives and risk tolerance
  • Monitor and report on the company’s litigation portfolio, including maintaining matter management systems, tracking costs, trends, and risk factors to the business and providing an actionable feedback loop to business leaders to improve escalation metrics
  • Develop and present training to various personnel throughout the organization on litigation risk mitigation, document retention, and best practices for reducing the company’s exposure to disputes
  • Other duties and assignments determined by the Assistant General Counsel to support internal stakeholders and continually enhance processes for execution of the company's strategies

Qualifications:

  • 5 or more years of litigation experience, including substantial experience in a law firm and/or in-house litigation role; experience managing complex commercial or regulatory litigation is highly preferred; public company experience a plus
  • Strong analytical and legal research skills with the ability to assess case law, evaluate risk exposure and develop creative litigation strategies
  • Motivated self-starter with a strong ownership mentality who creatively identifies and resolves issues
  • Familiarity with e-discovery tools and processes, litigation management software, and legal hold procedures
  • Ability to prioritize and work with a sense of urgency in a high-growth environment where priorities shift and judgment matters while delivering at a high level with a collaborative, customer service approach.
  • Exceptional degree of integrity, ethics and trust; highly professional with the ability to maintain confidence
  • J.D. from an accredited law school; admitted to at least one state bar in the U.S.
  • Exemplary written and verbal communication skills
