The Opportunity

We are looking for an accomplished Regulatory Compliance and Outsourcing Officer ("Compliance Officer") with demonstrative experience of regulatory and prudential compliance matters as well as experience of handling outsourcing activities intra-group. This is a new role, and the successful candidate will join our growing Compliance Team as part of our financial services business in Luxembourg.

The Compliance Officer reports into and supports the Chief Compliance Officer ("CCO") for MaplesFS; with a local reporting line to the Board of MFX and the local head of MFX. The tactical responsibilities feed one larger objective: ensure that Maples Fiduciary Services Luxembourg ("MFX") is, at all times, duly authorised and compliant to carry out financial services in accordance with the provisions of the rules as set out by the Commission de Surveillance du Secteur Financier ("CSSF") and authorisations held by MFX. They will work closely with the nominated Responsable du Controle ("RC") for MFX.

Primary responsibilities include:

• acting as the Regulatory Compliance and Outsourcing Officer for MFX;
• assisting the board of directors with the maintenance of the Luxembourg Regulatory Compliance programme, designed to comply with and detect violations of local and applicable Prudential 1 regulations and legislation in accordance with MFX's authorisations; including providing regular updates to the board and CCO (the Compliance programme is derived from the global MaplesFS Compliance strategic plan);
• being responsible on behalf of MFX for all matters relating to outsourcing; ensuring risk assessments are undertaken; the Cloud Officer(s) are able to undertake the required assessments; board approvals are obtained; submissions made to the CSSF and tracked to conclusion; registers are maintained, and other related matters;
• ensuring that Risk Assurance monitoring and testing as it relates to prudential and regulatory matters are undertaken; using global testing scripts where available or working with the global team to create new testing scripts;
• being responsible for the maintenance and relevance of MFX regulatory policies and procedures and contribute to any global documents;
• providing regular updates to the Administrateur Délégué in MFX, as required;
• being the principal point of contact for MFX with the external authorities including the CSSF and Ministry of Finance on day-to-day regulatory matters;
• being the point person for any CSSF regulatory-related inspections or thematic visits, ensuring remediation is handled appropriately with the business and providing support to the broader Compliance team on any Financial Crime-related examinations;
• providing backup to the RC in their absence (and the reverse will in place too);
• in the absence of the RC, reviewing any internal suspicious activity reports and, after suitable investigation, externalising any reports to the FIU as may be required;
• being available to work with the Financial Investigations Unit in the absence of the RC;
• completing any required self-assessment questionnaires for the CSSF and submitting via their portal; noting that for certain surveys the data collection is the responsibility of the business;
• participating as required in both internal audit and external audit reviews of the business, providing any necessary information on a timely basis;
• supporting the business in terms of all matters pertaining to regulatory and prudential compliance matters;
• providing face to face training and support on regulatory and prudential compliance matters; and
• providing advice, assistance and guidance for all Compliance related business activities.

What You Bring

In addition to indisputably high ethical standards and autonomy, the ideal candidate possesses the following:

at least four years’ previous experience as a Key Person2 in a similar role is preferred or in an equivalent senior role as the Compliance Officer or Deputy Compliance Officer;

• a university degree or at least 10 years in financial services in Compliance roles;
• a recognised Compliance qualification or equivalent qualification is preferred;
• excellent working knowledge of Luxembourg CSSF regulations and legislation including at least seven years' experience of working with Luxembourg Compliance and requirements;
• experience in Financial Crime regulations and legislation is an advantage;
• excellent communication skills both verbal and written (English is the language of MaplesFS);
• possess strong attention to detail and be able to manage time effectively;
• demonstrable team management experience.
