Coordinates and implements the construction claims management programs for all MWRA engineering and construction projects.

Location: Chelsea, MA
Salary: $1895.49-$2787.72 weekly $98,565.48-$144,961.42 annually
Work Schedule: Monday - Friday 8:30am - 4:30pm

Key Responsibilities

  • Implements and coordinates MWRA's construction contract claim process in accordance with policies and procedures that comply with M.G.L. Chapters 149 and 30.
  • Reviews contractor claims and prepares materials in support of Engineers' Decisions including contract language, related documents, drawings, interviews and correspondence.
  • Provides ongoing claims mitigation advice to Construction Coordinators and Construction Management staff.
  • Examines claims made by contractors and determines (in conjunction with Authority engineering and construction staff) responsibility for changes in scope of work, analyzes scheduling and financial impacts, and compliance with contract requirements and prepares written merit and procedural analysis and recommendation.
  • Coordinates and manages Claims Review Group (Law, Procurement, and Construction) activities to facilitate their review and independent recommendation on the disposition of claims.
  • Participates in negotiations and recommends settlement between Authority and contractors to minimize claims and avoid extensive legal costs, as requested.
  • Participates in review and investigation of potential design errors and omissions assessing potential damages and liability and negotiating settlements with design engineers, as requested.
  • Assists in reviewing and responding to both public records requests and litigation complaints and pleadings.
  • Attends meetings, hearings, court proceedings or mediations with in-house counsel, as requested.
  • Maintains and monitors an automated information system for the timely and accurate tracking and reporting of contract claims status.
  • Maintains historical data and files on contract claims in anticipation of litigation.
  • Performs related duties as required.

Required Qualifications

  • A Bachelor's degree in any field; and
  • Understanding of contract administration as acquired through at least five (5) years of professional services and construction contract management experience. A law degree may count for up to three (3) years of experience; or
  • Any equivalent combination of education or experience
  • A valid Massachusetts Class D Motor Vehicle Operators' License or driver's license from another state.

Knowledge and Abilities

  • Solid background in Massachusetts construction contract law and knowledge and familiarity with MGL. C. 149, and C. 30.
  • Experience overseeing and managing administrative processes related to professional services and construction contract claims.
  • Familiarity with personal computers and working knowledge of Microsoft Office Suite.
  • Must possess excellent communication and interpersonal skills.

Office machines as normally associated with a professional office environment, including the use of telephones, personal computers, word processing and other software, email, videoconference applications, copiers, scanners and fax machines.

The employee regularly works in an office environment. The noise level in the work environment is moderately quiet in office settings. The position may be eligible for telework up to 50% of the time.

Supervision Received and Exercised

Works under the general supervision the Assistant Director of Construction.
May provide guidance to Construction administrative or professional staff.
