Your Area of Work

The Compliance role will support the Japan Branch in its Regulatory Compliance and Financial Crime Compliance matters to comply with CBL Compliance, Group Compliance requirements and local regulations.

The Risk Management role (secondary role) in the Japan Branch will act as liaison with Head Office in supporting the development and implementation of the Clearstream risk strategy, risk limitation system and risk control processes.

Your Responsibilities

COMPLIANCE (90%)

General Compliance Management:

  • Assist in the management of corporate-related information.

  • Assist to maintain Compliance relevant information, which may contain “sensitive information”.

Customer Due Diligence (CDD):

  • Support Know Your Customer (KYC) process for customer on-boarding, and account opening.

  • Perform periodic or ad-hoc review of customer and/or accounts.

  • Act as the designated Money Laundering Reporting Officer (MLRO).

  • Provide compliance advice in relation to local laws and regulations, and internal policies and procedures on financial crime compliance.

  • Review customer transactions for suspicious transactions or red flags (e.g. fraud).

  • Handle New Issues escalations from 1LoD.

  • Advice on alerts clearance, if necessary.

  • File suspicious transaction report, if necessary.

Regulatory Compliance support:

  • Act as the designated JFSA Liaison Officer.

  • Handle queries and information requests from the authorities in a timely manner.

  • Provide advisory support and gaps analysis in regulatory compliance matters including the analysis of local news or revised regulatory requirements.

  • Ensure regulatory compliance of the Branch with Japanese banking laws in general and regulations related to foreign bank agency services in particular.

  • Provide support in regulatory reporting and perform certain periodic/ad-hoc reporting to authorities.

  • Maintain and update the Legal Inventory for material laws and regulations.

Reporting and Governance:

  • Adhere to the required Compliance governance for the Branch, ensuring open communications with Clearstream Asia and Head Office Compliance

  • Prepare the required compliance reporting, in line with the implemented governance.

  • Assist in performing periodic review of the Branch’s compliance manuals and ensure they are aligned with CBL Compliance procedures.

  • Prepare for Quarterly Compliance meetings and take minutes.

Audit & Regulator Visits to the Branch:

  • Act as the local coordinator.

  • Review audit and regulatory findings; provide support, in consultation with Asia Compliance, to draft appropriate response and development of remediation action plan.

  • Provide relevant information for audits and regulatory visits.

Others:

  • Take part in Compliance initiatives.

  • Support the Asia compliance team in the handling of compliance matters relating to Clearstream entities.

  • Ensure full completion by staff in Japan for compliance related training and deliver onsite dedicated compliance trainings where necessary.

  • Provide ad-hoc translation support (from Japanese to English or vice versa) relating to requests by regulators.

  • Perform any other ad-hoc task that may be assigned from time to time, provided that it is in line with the compliance mandate.

RISK MANAGEMENT (10%)

With regards to the Japan Branch:

  1. Support the monitoring of operational risks and reporting of key Risk indicators to Head Office.

  1. Support the controlling of business risks.

  1. Support the preparation of regular and ad-hoc internal risk reports or statutory risk surveys.

  1. Support the development and implementation of the Clearstream risk strategy, risk limitation system and risk control processes.

  1. Support the risk inventory assessment process.

  1. Monitor the risk situation and profile of the Branch.

  1. Provide regular risk relevant input and participate in Major Change Working Group for services/products impacting the Japanese Branch.

  1. Escalate relevant risk matters to the Head Office.

  1. Coordinate regulatory breaches and other regulatory matters, include supporting the assessment, mitigation and report.

*The responsibility of the Risk Management function may be extended after the establishment of the Treasury Function at the Branch and opening of account with BOJ.

Your Profile

  • Years of experience At least 8 to 10 years of work experience - Minimally 7 years in compliance Educational QualificationsUniversity degree

  • Strong working knowledge on banking regulations and compliance guidelines in Japan.

  • Proficiency in written and spoken English (must-have)

  • Advanced skills in MS Word, Excel and Co-Pilot.

  • Exposure to Financial International Sanctions will be an asset.

  • Independent and analytical with excellent interpersonal and organizational skills; comfortable in running the one-man operation in compliance function at the Japan Branch.

  • Good communication skills with the ability to communicate effectively across time-zones and different cultural backgrounds.

  • Highly motivated team player who thrives in an international work environment and possesses a global perspective. Ability to understand and transform complex data and produce meaningful analytics
