Job Description

Role Purpose

  • Responsible to strategically plan, effectively execute, timely manage, administer and monitor pre and post award contract and procurement activities & performance in compliance with Mubadala Energy, PETRONAS and Government procedures and regulations in order to enable the organization to systematically control governance and risks against exposure to cost recovery.
  • Particular experience is needed in all commercial and certain technical aspects of contract creation and execution including management / administration and performance for contracts with a strong emphasis in managing and executing pre-development contracts and EPCIC (Engineering, Procurement, Construction, Installation, and Commissioning) / EPCC (Engineering, Procurement, Construction, and Commissioning) / and EPC (Engineering, Procurement, and Construction) tenders and contracts for offshore development projects including any associated and support services such as development drilling & production operations contracts, etc. This includes executing the full spectrum of pre and post-award activities to ensure compliance, timely execution and optimization of contractual outcomes for complex projects.

Key Accountabilities

Procurement Planning

  • Responsible to prepare, design and coordinate preparation of detailed procurement work plan in-line with approved Business Plan and Budget.

Responsible for Effective Supplier Selection

  • Champion in bid planning, contract award and contract performance.
  • Execute competitive supplier selection: contracting strategy formulation, receive requisitions, analyze requirement, specifications, drawings, delivery requirements, prepare bid, request pricing and delivery, process queries from bidders, prepare bid evaluation programs; perform cost /price analysis and priced commercial evaluation of bids; lead negotiation and develop negotiating proposals; place award, develop contract and formalities.
  • Responsible in providing significant input to contract development (including umbrella contracts) & execution management, forecasting of estimated contract value, support in risk identification, assessment, mitigation and monitoring to meet Mubadala Energy objectives.
  • Responsible in ensuring procurement process and contract execution aligns with PETRONAS OGP 423, Mubadala Energy Operations Management System (OMS), Mubadala Energy Contractor Management Standard (CMS) and Mubadala Energy Contractor HSE Management System (CHSEMS).
  • Monitor that all required internal and external tender reports related to SCM activities are endorsed / approved as per DoA.

Bid & Contract Development

  • Performs the primary role in contract drafting, ensuring that technical, administrative and contractual materials are explicit and correctly captured and drafted to achieve a coherent set of documents which forms an unambiguous and manageable contract.
  • Responsible in avoiding / minimizing contractor's defaults through contract drafting to avoid delays in completion and increasing actual service cost.
  • Responsible in coordination multi-functions bid review (User, Legal, Finance, Insurance, Risk, HSSE, etc.) to ensure technically and commercially sound bid document. Ensure bid document includes provisions to mitigate risks inherent to the nature of work, assignment of responsibility for associated risk exposures to the party that is best positioned to mitigate its impact.

Deliver Effective Contracts Management Scope

  • Assume the lead role in day-to-day management, administration, compliance and functional interface of pre-development contracts and complex EPCIC/EPCC/EPC contracts including any associated and support services such as development drilling & production operations contracts, etc, leveraging specialist knowledge of these contract types to navigate and resolve challenges inherent to large-scale engineering and construction projects. This includes navigating complex interpersonal dynamics with challenging users while ensuring that contract performance meets all technical, commercial, and HSSE requirements, while also managing contract claims, variations, and amendments with precision.
  • Responsible in providing the contract & commercial expertise and frameworks to support the delivery of assigned scope.

Leading in contract execution and administration, which include:

  • Ensuring timely resolution of disputes, effective negotiation of variations and maintaining productive relationships with stakeholders even in difficult situations.
  • Use strong communication and conflict resolution skills to manage contractor performance issues, mitigate risks early and avoid delays or disruptions to project timelines.
  • Identify contract's KPI for medium-high risk contracts.
  • Coordinate monitoring of contract's performance meeting for all high-risk contracts, including engagement in contract / contractor performance monitoring meetings, consequence management related to suppliers' performance, regular report on supplier performance.
  • Manage administration of post award matters; secure contract security documents (bank guarantee, performance guarantee, insurances), monitor utilization of contract value, changes, amendment and contract claims, contract extension or renewal, claims, disputes, monitor close-out process of open PO process (on paper and on Oracle system)

Procurement Governance, Compliance and Controls

  • Implement approved SCM Policies & Procedures and ensure that the work carried out in controlled manner.
  • Responsible in ensuring standards of ethics, fairness in procurement activities are maintained, seek to uphold and enhance the integrity of the procurement process as well as maintain strict confidentiality of documents pertaining to procurement.

Cost Management Initiatives

Achieve the best savings in Terms of OPEX and CAPEX cost from the procurement activities including:

  • Value generation from bid strategy,
  • Creation of well drafted & enforceable contract,
  • Contract re-negotiation / cost avoidance activities,
  • Minimizing claims and disputes,
  • Effectively allocate risk,
  • Contract sharing opportunities with other Operators

Reporting and Audit

  • Maintain periodic external reports for relevant government bodies to ensure compliance to the regulations
  • Maintain periodic internal reports for the management to enable management control.
  • Responsible in ensuring business controls, documents and reports withstand audits.

Continuous Improvement and Others

  • Participate in MYBU Young Council Program and CSR programs.
  • Stakeholders relationships built and effectively managed.

Knowledge, Skills & Experience

Knowledge:

  • Bachelor's degree in engineering, Business Administration, Finance or equivalent.
  • A sound knowledge of PETRONAS Procurement Standard (PPS). Knowledge on PETRONAS Governing Standards (previously known as PETRONAS Procedure and Guidelines for Upstream Activities (PPGUA) on 'Field Development & Project Governance' is an added advantage.
  • Maintain high standards of ethics, fairness in procurement activities, seek to uphold and enhance the integrity of the procurement process as well as maintain strict confidentiality of documents pertaining to procurement.

Experience:

  • Minimum 12 years of experience in oil & gas supply chain management including significant exposure to Malaysia oil and gas upstream activities. Strong experience in managing the full lifecycle of pre-development and EPCIC/EPCC/EPC contracts, including any associated and support services such as development drilling contracts etc. is essential, with a proven track record in both pre and post-award procurement activities for large-scale engineering projects.
