The Alberta Serious Incident Response Team (ASIRT) a branch of the Police Review Commission (PRC) is Alberta’s civilian-led police oversight body, responsible for independently investigating police officers where allegations of criminal & statutory conduct arise, and for investigating Level 1 peace officer matters involving serious injury, death, or other significant incidents. All matters under ASIRT's investigative, review, or oversight authority are designated as serious or sensitive by the PRC's Chief Executive Officer or delegate under the Police Act.

Role Responsibilities

Reporting to the Executive Director, the Assistant Executive Director, provides legal, operational, and strategic support to the Executive Director in the delivery of ASIRT’s mandate.

The position supports the Executive Director in the advancement of investigations by providing legal advice, analysis, and recommendations to inform decision-making. This includes contributing to the assessment of investigative findings and supporting the development of legal strategies in alignment with legislative requirements and jurisprudence. Final determinations regarding the laying of charges remain the responsibility of the Executive Director as statutory decision-maker.

Duties:

  • Provides advanced legal expertise and subject-matter knowledge to support ASIRT’s investigative processes, ensuring alignment with applicable legislation, common law, and standards of professional legal practice.
  • Provides legal advice to support the lawful conduct of investigations and evidence collection in accordance with the Criminal Code and the Canadian Charter of Rights and Freedoms.
  • Reviews investigative materials and provides legal analysis to support the preparation of files for Crown review and potential prosecution by the Alberta Crown Prosecution Service.
  • Applies advanced knowledge of law relating to the authority of police officers and peace officers, including the legal justification for the use of force and the exercise of that authority, and provides advice to support investigative and legal decision-making.
  • Provides legal advice and analysis on complex, sensitive, and high-profile matters, including jurisdictional issues, evidentiary standards, and procedural fairness, to support consistent and defensible outcomes.
  • Contributes to the development and consistent interpretation of legal frameworks, administrative law principles, and investigative procedures, supporting alignment across ASIRT operations.
  • Provides legal input into disclosure processes, including review of records, identification of legal risks, and support for compliance with disclosure obligations, including considerations of privilege and statutory requirements.
  • Provides advice in relation to litigation-related matters, including preparation for hearings, judicial reviews, or other proceedings, supporting the development of legally sound positions and mitigation of risk.
  • Liaises, as required, with internal and external legal stakeholders, including the Ministry of Justice, to support alignment of legal interpretations and approaches.
  • ASIRT operates 24 hours a day, seven days a week. Given the unpredictable, time-sensitive and high-risk nature of ASIRT’s work, the Assistant Executive Director must maintain the availability and flexibility required to provide timely legal and operational guidance, support immediate responses to critical incidents and assume delegated leadership responsibilities when required.

Qualifications

Education, certifications and/or training

  • Related undergraduate law degree. Equivalencies may be considered.
  • Member of the Law Society of Alberta or be eligible for admission.

Job-specific experience:

  • Eight years or more experience in practicing criminal law.
  • Significant senior management experience.
  • Experience developing successful working relationships across a wide array of stakeholders.
  • Experience leading change management efforts.

Technical competencies

  • Expert knowledge of criminal law and procedure including criminal investigative techniques.
  • Expert knowledge of criminal prosecutions in Alberta and the Alberta Crown Prosecution Service.
  • Expert understanding of the Police Act, Criminal Code, Canada Evidence Act and other applicable legislation.
  • Expert understanding of criminal investigative techniques and compliance with the Criminal Code and Charter of Rights and Freedoms.
  • Cultural competencies for working with Indigenous and diverse communities.
  • Proven negotiation and facilitation skills to work with stakeholders with varied requirements and agendas and resolve conflicts.
  • Demonstrated interpersonal and consulting skills, including the ability to establish and maintain effective working relationships with senior representatives across government, sector, and department.
  • Professional judgment and decision-making skills along with conceptual and critical thinking skills to monitor and evaluate systems and processes and work toward continuous improvement.

Notes

  • There is one full time, permanent position. Candidate can be located in either Calgary or Edmonton
  • Final candidates will be required to undergo, pass and maintain a federal and level of security clearance throughout their employment at ASIRT. Background checks, including a review of previous law enforcement service history and disciplinary history, will be considered.
  • A valid class 5 Drivers license is required.
