Background

The Offices of the Official Solicitor and Public Trustee (OSPT)

The office is an Arms’ Length Body of the Ministry of Justice and combines the duties and responsibilities of two separate independent statutory office holders - the Official Solicitor to the Senior Courts and the Public Trustee. It is a small niche office with around 135 staff who support the work of the Official Solicitor and Public Trustee, including lawyers, lay case managers and administrators; The Official Solicitor promotes access to justice for the most vulnerable members of our society who might otherwise be unable to use the services offered by the justice system due to their lack of mental capacity or because of their young age. We are committed to providing the best level of service we can for our clients.

In the majority of her cases, the Official Solicitor acts as last resort litigation friend for adults who lack mental capacity and in some cases solicitor, or for children (other than those who are the subject of child welfare proceedings).

The Official Solicitor has responsibility for four Litigation teams: Healthcare and Welfare (Court of Protection), Family Litigation, Civil Litigation and Property and Affairs (Court of Protection).

The OSPT has an Executive Officer (EO) vacancy for a Pre-acceptance Case Manager in her Healthcare and Welfare Team.

The Healthcare and Welfare Team

The Healthcare and Welfare team deal with applications under the Mental Capacity Act 2005 in the Court of Protection. These applications ask the court to make declarations in the best interests of the person who is the subject of the application (known as P´) and cover a wide range of issues from medical treatment, to where P should live, with whom P should have contact and how care should be provided to P. The factors which inform all decision making under the Mental Capacity Act are the determination of capacity´ and `best interests´. The team also deals with applications relating to circumstances under which P is deprived of liberty in breach of his or her rights under Article 5 of the European Convention on Human Rights.

The Executive Officer (EO) Role of Pre-Acceptance Case Manager:

The main purpose of this role is to manage and progress referrals and cases efficiently, ensuring all actions are completed within agreed Key Performance Indicators. It involves maintaining accurate records, escalating complex issues appropriately, and contributing to team performance through proactive case management, collaboration, and continuous personal development.

The successful candidate will have considerable contact with the legal profession as well as a wide range of individuals and agencies involved with the client. Supported by a Team Leader, and lawyers where necessary, you will manage your own case load and manage the team shared inbox on a rota basis. You may also line manage at least one AO case manager.

SKILLS & QUALITIES:

Essential Criteria

The EO role will require someone who is engaged in their work, self-motivated, a team player and able to work under pressure. Excellent skills in making effective decisions and communicating and influencing is essential.

Strong resource management and technical skills are therefore important in this role, as is the ability to encourage and support good morale and staff wellbeing.

The role encompasses a number of motivating and challenging priorities including:

  • Progressing new cases by obtaining documented evidence from third parties to ensure referrals meet the Official Solicitor’s acceptance criteria.
  • Drafting a file summary for every case in an informative detailed manner to ensure key information is highlighted to enable Senior Case Managers to progress appropriately when allocated.
  • Taking a proactive role in stakeholder engagement activities.
  • Supporting and assisting the Team Leader to collate, maintain and present accurate management information.

It is essential that you have experience of using Microsoft software packages, i.e. Word, Excel, Outlook, PowerPoint and Teams

Application and Selection Process

Should a large number of applications be received, an initial sift may be conducted using the lead behaviour, Making Effective Decisions. Candidates who pass the initial sift may be progressed to a full sift or progressed straight to interview.

Candidates will also be assessed on relevant Civil Service Strengths at interview. Interviews will be held virtually by the Microsoft Teams platform.

A reserve list may be held for a period of 12 months from which further appointments can be made.

The OSPT is based at 102 Petty France, London, but the successful candidate does not have to be London-based. We currently operate a hybrid working arrangement. This means that as a minimum 40% of the working week is office based, subject to further notice. Nationally based workers will be appointed to their nearest Justice Collaboration Centre or Justice Satellite Office.

Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.

Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.

For nationally advertised roles: All successful candidates will be appointed to the nearest viable office nearest to their home postcode and on its respective pay scale. This will be at either a HQ building (subject to desk allocation, a Justice Collaboration Centre (JCC) or a Justice Satellite Office (JSO) – See Map. All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity).

For current MoJ employees, your base location will need to be changed to the nearest viable office (to your home postcode), either at a HQ building, JCC or JSO within the National Office Network and moved its location’s respective pay scale (any legacy arrangements/locations will need to be amended).

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.

MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.

All candidates who are currently in receipt of Mark Time / Pay Protection should ensure they are familiar with the new policy on permanent and temporary promotion which can be found on the employee intranet.

Flexible working hours

The Ministry of Justice offers a flexible working system in many offices. Standard full time working hours are 37 hours per week. MoJ welcomes part-time, flexible and job-sharing working patterns, where they meet the demands of the role and business needs.
